1. Acceptance of Terms

By accessing or using Swisy ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Swisy provides AI-powered image editing tools, including but not limited to image retouching, object removal, and upscaling. The Service uses third-party AI models (including Google's image generation models, Topaz, and Crystal) to process your images.

3. Account & Eligibility

You must be at least 13 years old to use the Service. By creating an account, you represent that:

The information you provide is accurate and complete
You will maintain the security of your account credentials
You are responsible for all activity under your account

4. Credits & Billing

Swisy operates on a credit-based system:

Free accounts receive a one-time allotment of 35 credits
Paid subscriptions renew automatically at the end of each billing cycle
Unused credits do not roll over to the next billing period
Credits are non-transferable and have no cash value
Prices are subject to change with 30 days' notice

5. Cancellation & Refunds

Cancellation: You may cancel your subscription at any time through your User Dashboard. Your access will continue until the end of the current billing period.

Refunds: We offer a full refund if no credits have been used since your most recent payment. Refund requests are processed within 1-2 business days.

Plan Changes: Upgrading or downgrading between plans is currently not available. To change plans, cancel your current subscription and subscribe to a new plan.

6. Acceptable Use

You agree not to use the Service to:

Generate illegal, harmful, or offensive content
Create non-consensual intimate imagery of real people
Infringe on intellectual property rights of others
Attempt to bypass usage limits or security measures
Resell or redistribute the Service without authorization

We reserve the right to suspend or terminate accounts that violate these terms without refund.

7. Intellectual Property

Your Content: You retain all rights to images you upload. You grant Swisy a limited license to process your images solely for providing the Service.

Output Ownership: You own the outputs generated from your images. You may use outputs for any purpose, including commercial use, on all plans (including Free).

Our Content: Swisy's branding, design, and underlying technology remain our property.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that AI-generated outputs will be error-free, accurate, or suitable for any particular purpose. Results may vary based on input quality and AI model behavior.

9. Limitation of Liability

To the maximum extent permitted by law, Swisy shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
